This FAQ should help answer many questions that prospective clients may have:
Q: What Is A Divorce Going to Cost Me?
A: The numbers vary and depend on whether the divorce avoids litigation. It’s important to remember, it’s much costlier to undue an agreement reached, that may have never happened with proper representation.

Q: Can I Change My Name with The Divorce?
A: Yes, either party can revert to his/her pre-marriage name at the end of the process.

Q: What Forms Do I Need to Begin A Divorce?
A: In New York, all you’ll need to file is a Summons with Notice. This lets your partner and the courts know that divorce proceedings have begun.

Q: How Is Child Custody Determined?
A: There are numerous complex variables involved in determining child custody. These can include but are not limited to (1) which parent is the primary caretaker, (2) where does the child currently live and for how long, (3) results of any court ordered or routine evaluations, (4) and the child’s wishes as presented by the attorney for the child.  

Q: What Course of Action Should I Take If I’m A Victim of Domestic Abuse?  
A: Please visit the court’s Domestic Violence web page for a complete list of information and resources. In addition, you have the option to apply for an Order of Protection.  

Q: How does the court decide equitable distribution?
A: The court looks closely at 14 statutory factors, like the length of the marriage and the contributions by the spouses.  

Q: What’s the difference between alimony and maintenance?
A: The terms are different but the mean the exact same thing. Courts consider several different factors like the standard of living established at the time of marriage, the reasons for divorce, among other things.
